What The Law Says About Generated Fitness Certificates?

The same BNS Section 234 that covers sick notes also covers fitness certificates. According to this, 

“Whoever issues or signs any certificate required by law to be given or signed, knowing or believing such a certificate to be false in any material point, shall be punished in the same manner as if he gave false evidence”

The penalty for this is up to 7 years of imprisonment, Rs. 10,000 fine or both; the same as for sick leave certificates.

  1. HR/Admissions Verification: They verify the certificate upon submission and checks the NMC number against the Indian Medical Register. 
  2. Periodic Occupational Health Audits: Under this, all certificates are re-verified as part of routine compliance. 

If a discrepancy is found later (be it during an insurance claim, a workplace injury investigation or a routine HR audit), the original submission will become criminal matter. The risk timeline for a fitness certificate is much longer than for a one-off sick note.
